Terms of Service

BY ACCEPTING THIS AGREEMENT, BY (1) CLICKING A BOX INDICATING ACCEPTANCE, (2) EXECUTING AN ORDER FORM THAT REFERENCES THIS AGREEMENT, OR (3) USING FREE SERVICES, COMPANY AGREES TO THE TERMS OF THIS AGREEMENT. IF THE INDIVIDUAL ACCEPTING THIS AGREEMENT IS ACCEPTING ON BEHALF OF A CORPORATION OR OTHER LEGAL ENTITY, SUCH INDIVIDUAL REPRESENTS THAT THEY HAVE THE AUTHORITY TO BIND SUCH ENTITY AND ITS AFFILIATES TO THESE TERMS AND CONDITIONS, IN WHICH CASE THE TERM “COMPANY” SHALL REFER TO SUCH ENTITY AND ITS AFFILIATES. IF THE INDIVIDUAL ACCEPTING THIS AGREEMENT DOES NOT HAVE SUCH AUTHORITY, OR DOES NOT AGREE WITH THESE TERMS AND CONDITIONS, SUCH INDIVIDUAL MUST NOT ACCEPT THIS AGREEMENT AND MAY NOT USE THE SERVICES.


Blanchard Systems Inc. ("BSI") maintains this website ("Site") in an attempt to provide you with comprehensive Software as a Service ("Saas") for the submission, approval and delivery of digital materials. In addition, the Site can be used to convey information about BSI's products and services. BSI requires that all the visitors to our Site (s) on the Internet adhere to the following rules and regulations. By accessing the Site, you indicate your acknowledgment and acceptance of all Blanchard Systems AGREEMENTS to include but not limited to TERMS OF SERVICE ("TERMS"), MASTER SERVICES AGREEMENT (MSA), SERVICE LEVEL AGREEMENT (SLA) collectively referred to as AGREEMENTS. These documents can be found on http://www.blanchardsystems.com/agreements. Please read them carefully.


THE CONTENTS OF THE PUBLIC SITE, INCLUDING ITS "LOOK AND FEEL" (E.G., TEXT, GRAPHICS, IMAGES, LOGOS, AND BUTTON ICONS), EDITORIAL CONTENT, NOTICES, SOFTWARE (INCLUDING BUT NOT LIMITED TO HTML-BASED COMPUTER PROGRAMS), AND OTHER MATERIAL ARE PROTECTED UNDER BOTH UNITED STATES AND FOREIGN COPYRIGHT, PATENT, TRADEMARK, AND OTHER LAWS. The contents belong to BSI or to others as indicated. The information and materials contained in the Site may not be copied, displayed, distributed, downloaded, licensed, modified, published, reposted, reproduced, reused, sold, supplemented, transmitted, used to create a derivative work or otherwise used for public or commercial purposes without the express written permission of BSI. You agree not to reproduce, duplicate, copy, sell, resell, use or exploit for any commercial purposes, the Site or use of or access to the Site or any information or technology obtained from the Site.


You agree that all access and use of the Site and its contents is at your own risk. By using the Site, you acknowledge that we specifically disclaim any liability (whether based in contract, tort, negligence, strict liability or otherwise) for any direct, indirect, incidental, common law, statutory, regulatory, consequential, compensatory, punitive, or special damages arising out of or in any way connected with your access to or use of the Site (even if we have been advised of the possibility of such damages) including, but not limited to, any liability associated with incorrectly processing of images, text, application files or any other digital content, or viruses which may infect your computer equipment. In addition, BSI makes no warranty that the service will meet your requirements or that the service will be uninterrupted, timely, secure, or error free. BSI assumes no responsibility for the deletion or failure to store any data or other information provided by you on the service.


You are responsible for maintaining the confidentiality of your log-in name and password and for any and all activities that occur under your password or account. You agree to immediately notify BSI of any unauthorized use of your account or any other breach of security known to you.


This disclosure shall be governed in all respects by the substantive laws of the State of Louisiana, without regard to its provisions relating to conflict of laws. To exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. If any provision of the Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the AGREEMENTS remain in full force and effect.


BSI reserves the right to change the above terms of use and disclaimers at any time. Such changes will become effective and binding after their posting on BSI's website. The website user agrees to regularly review BSI AGREENENTS and be aware of the changes made. By continuing to use the BSI website after any posted revision, the customer agrees to abide by it.



Blanchard Privacy Policy

Blanchard System Inc., (BSI) is strongly committed to protecting your privacy while interacting with our content, products and services. Our goal is to provide a safe and secure environment for our customers.


The purpose of this Privacy Policy is to tell you what kind of information we gather about you when you visit our Site, how we may use that information and whether we disclose it to anyone.


Information is collected primarily to create a closed loop environment for the submission and approval of digital material. Depending on the service we are providing, you could be asked to provide information such as your name, physical address, email address, phone number and possibly credit card information. Under no circumstances will BSI share, sell or receive payment for licensing or disclosing your personal information.


BSI collects two types of information. The first type is anonymous information. For instance, we may collect information to tell us that five thousand people visit this Privacy Policy today, but we do not know their names, where they live or their date of birth - they are 'anonymous' to us.


The second type of information that BSI collects is personal information. BSI will collect personal information that allow us to know the specifics of who you are such as your name, email address, physical address. This information allows BSI to provide messaging to create a compressive digital material supply chain product.


Ultimately, you are solely responsible for maintaining the secrecy of your passwords and/or any personal information. Be responsible whenever you are online.
